PepMed ("PepMed," "we," "our," or "us") provides websites, patient-facing digital services, educational content, communication tools, connected health features, telehealth functionality, and related services.

These Terms of Use ("Terms") govern your access to and use of PepMed's websites, patient portal, digital features, communications services, wearable integrations, and other services to which these Terms are presented or linked.

Healthcare services provided through PepMed may also be subject to additional patient agreements, informed consents, telehealth consents, financial policies, privacy notices, and clinical policies.

Please read these Terms carefully. By accessing or using PepMed's Services, you agree to these Terms. If you do not agree, do not use the applicable Services.

1. Scope of These Terms

These Terms may apply to:

  • Patient registration and accounts.

  • Patient-portal functionality.

  • Telehealth-related technology.

  • Educational content and PepTalk articles.

  • Contact forms.

  • Waitlist and service notifications.

  • Other digital features provided by PepMed.

2. Eligibility

Unless otherwise expressly stated, PepMed's Services are intended for individuals who are at least 18 years old.

By creating an account, submitting patient information, or using Services requiring legal consent, you represent that you are legally capable of entering into the applicable agreement.

Healthcare services are available only where permitted by applicable law and where an appropriately licensed healthcare provider is authorized to provide care.

3. Patient Accounts

Certain PepMed Services may require you to create an account.

You agree to:

  • Provide accurate and complete information.

  • Keep account information current.

  • Maintain the confidentiality of your login credentials.

  • Not permit unauthorized persons to use your account.

  • Notify PepMed if you believe your account has been compromised.

You are responsible for activity occurring through your account to the extent permitted by law.

4. Provider-Patient Relationship

Accessing PepMed's public Website, reading educational information, joining a waitlist, or creating a general account does not by itself establish a provider-patient relationship.

A provider-patient relationship is established only when applicable clinical, legal, licensure, consent, and onboarding requirements have been satisfied and a PepMed-affiliated healthcare provider undertakes to provide care.

Healthcare decisions are made by appropriately licensed healthcare professionals exercising independent clinical judgment.

PepMed does not guarantee that a provider will determine that any particular treatment, medication, laboratory test, or service is medically appropriate.

5. Not Medical Advice

General Website content, PepTalk articles, FAQs, wellness information, research summaries, wearable-data displays, automated information, and other educational materials are provided for informational purposes.

Unless information is specifically communicated to you by an appropriately licensed healthcare professional as part of an established provider-patient relationship, it should not be considered individualized medical advice.

Do not use general Website information to independently diagnose or treat a medical condition.

6. Medical Emergencies

PepMed's Website, patient portal, wearable integrations, email, SMS services, and general communication channels are not emergency-monitoring systems.

Do not rely on PepMed, connected wearable devices, automated notifications, email, or SMS for emergency medical care.

If you believe you are experiencing a medical emergency, contact emergency services available in your location immediately.

PepMed does not guarantee continuous monitoring of wearable information or patient communications.

7. Telehealth Services

Healthcare services may be delivered using telehealth technologies.

Telehealth services are subject to applicable state law, provider licensure, patient eligibility, clinical appropriateness, and any separate telehealth consent presented during onboarding.

Technical problems, internet connectivity, device limitations, or service interruptions may affect telehealth availability.

PepMed does not guarantee that telehealth is appropriate for every medical condition.

8. Communications and Electronic Notices

By providing contact information to PepMed, you authorize PepMed to communicate with you through the channels you select or otherwise authorize, subject to applicable law and your communication preferences.

Communications may include email, telephone, patient-portal messages, or SMS/text messaging.

Electronic communications involve inherent privacy and security risks. You are responsible for maintaining reasonable security over devices and accounts used to receive PepMed communications.

9. SMS/Text Messaging Terms

PepMed may offer SMS/text-message communications for purposes including:

  • Appointment confirmations.

  • Appointment reminders.

  • Scheduling updates.

  • Account notifications.

  • Security or verification messages.

  • Patient-service notifications.

  • Prescription, pharmacy, or medication-status notifications where appropriate.

  • Other transactional communications.

  • Promotional or marketing communications where separately authorized.

PepMed may use Twilio or another communications provider to facilitate text-message delivery.

By providing your mobile telephone number and affirmatively opting into an applicable PepMed messaging program, you consent to receive messages relating to the purposes described when consent is collected.

Message frequency varies. Message and data rates may apply.

You may opt out of applicable SMS communications at any time by replying STOP.

For assistance, reply HELP where supported or contact PepMed.

Consent to receive marketing text messages is not a condition of purchasing healthcare services or products from PepMed.

Opting out of SMS may prevent you from receiving optional text reminders or notifications. PepMed may continue to contact you through other authorized channels where reasonably necessary to provide healthcare or services.

Wireless carriers are not liable for delayed or undelivered messages.

You are responsible for providing PepMed with an accurate mobile number and notifying PepMed if your mobile number changes.

10. Email Communications

PepMed may communicate through email regarding:

  • Appointments.

  • Account activity.

  • Healthcare services.

  • Requested information.

  • Educational content.

  • Service announcements.

  • Pharmacy or delivery information.

  • Marketing communications where permitted.

PepMed may use Twilio SendGrid or other service providers to facilitate email delivery.

Marketing communications may be unsubscribed from using the method provided in the applicable communication.

Opting out of marketing emails does not prevent PepMed from sending transactional, security, legal, account, healthcare, or service-related communications where permitted.

11. Wearable and Connected Health Integrations

PepMed may permit users to connect compatible wearable devices, health applications, or health-data platforms, including services associated with Apple, Google, Fitbit, Oura, WHOOP, and other supported providers.

Connecting these services is voluntary unless expressly stated otherwise.

You control which permissions you grant through the applicable third-party platform.

By connecting a service, you authorize PepMed to access and process the categories of information you approve for purposes described at the time of authorization and in PepMed's Privacy Policy.

You may revoke or modify permissions through the applicable platform where supported.

PepMed does not control and is not responsible for:

  • The accuracy of third-party wearable information.

  • Device malfunctions.

  • Missing or delayed measurements.

  • Third-party algorithms or calculations.

  • Changes made by third-party platforms.

  • Third-party outages.

  • A third party's decision to discontinue or modify an integration.

Wearable devices and connected health services are not substitutes for professional medical evaluation and should not be relied upon for emergency monitoring.

Healthcare providers may consider wearable information as one source of information when clinically appropriate but retain independent clinical judgment.

12. Third-Party Wearable Terms

Your use of Apple Health, Google Health Connect, Fitbit, Oura, WHOOP, or another connected service remains subject to your agreement with that provider.

PepMed's ability to access information may change if:

  • You revoke authorization.

  • The provider changes its API.

  • The provider modifies its terms.

  • The integration becomes unavailable.

  • PepMed determines continued integration is no longer appropriate.

PepMed may modify or discontinue a connected integration at any time.

13. Prescriptions and Electronic Prescribing

Prescriptions may be issued only when an appropriately licensed healthcare provider determines, in the provider's independent clinical judgment, that a prescription is medically appropriate and legally permitted.

PepMed may use electronic prescribing networks or technology providers, including Surescripts, to facilitate transmission of prescription information to a pharmacy.

Use of electronic prescribing technology does not guarantee that:

  • A medication will be prescribed.

  • A pharmacy will accept or fill a prescription.

  • A medication will be available.

  • A medication will be compounded or dispensed.

  • A prescription will be processed within a particular period.

  • A particular pharmacy can ship to your location.

Clinical prescribing decisions remain solely within the professional judgment of the applicable licensed healthcare provider.

14. Pharmacy Services

Prescription medications may be dispensed by independent licensed pharmacies.

A dispensing pharmacy is responsible for pharmacy services within its professional and legal responsibilities, including dispensing, preparation, labeling, and other pharmacy functions.

PepMed does not control all aspects of a pharmacy's operations and cannot guarantee medication availability or dispensing timelines.

The pharmacy may contact you directly regarding a prescription, medication, payment, fulfillment, delivery, or other pharmacy-related matter.

15. Medication Delivery

A dispensing pharmacy or fulfillment provider may arrange for medication to be delivered to your designated address using UPS Healthcare or another qualified logistics provider.

Delivery times are estimates unless expressly guaranteed by the applicable carrier.

PepMed is not responsible for delays or failures caused by circumstances outside PepMed's reasonable control, including:

  • Carrier delays.

  • Incorrect addresses provided by the patient.

  • Weather.

  • Natural disasters.

  • Transportation disruptions.

  • Failed delivery attempts.

  • Required signatures.

  • Access restrictions.

  • Theft after confirmed delivery.

  • Other carrier-related events.

Certain medications may require specialized packaging, temperature controls, delivery procedures, or signatures.

You are responsible for providing accurate delivery information and following any storage, handling, refrigeration, or other instructions provided with your medication.

Contact PepMed or the dispensing pharmacy promptly if a medication arrives damaged, compromised, at an inappropriate temperature where temperature control is required, or otherwise appears unsuitable for use.

Do not use medication that you reasonably believe has been damaged or compromised without first obtaining appropriate guidance.

16. Medications and Treatment

Information presented through PepMed does not guarantee access to a particular medication or treatment.

Treatment depends on factors including:

  • Medical appropriateness.

  • Provider judgment.

  • Patient history.

  • Laboratory information.

  • Applicable law.

  • State availability.

  • Pharmacy availability.

  • Medication availability.

  • Regulatory requirements.

PepMed does not guarantee that a particular treatment will be appropriate for you.

17. Compounded Medications

PepMed healthcare providers may, where clinically appropriate and legally permitted, prescribe compounded medications.

Compounded medications are not FDA-approved in the same manner as FDA-approved drug products. The FDA does not review compounded medications for safety, effectiveness, or quality before marketing in the same manner as FDA-approved drugs.

The decision to prescribe a compounded medication is made by an appropriately licensed healthcare provider based on clinical judgment, applicable law, patient circumstances, and product availability.

Additional medication-specific disclosures or consents may be provided where appropriate.

18. No Guarantee of Results

Healthcare and wellness outcomes vary between individuals.

PepMed does not guarantee:

  • Weight loss.

  • Muscle gain.

  • Improved performance.

  • Improved recovery.

  • Improved sleep.

  • Longevity outcomes.

  • Cosmetic outcomes.

  • Specific laboratory changes.

  • Any other particular health or wellness result.

Past outcomes, testimonials, statistics, examples, or educational information do not guarantee individual results.

19. Third-Party Services

PepMed relies on third-party technology and service providers.

These may include providers supporting:

  • Electronic health records.

  • Telehealth.

  • Communications.

  • Email.

  • SMS.

  • Electronic prescribing.

  • Pharmacies.

  • Laboratories.

  • Payment processing.

  • Medication delivery.

  • Wearable integrations.

  • Cloud infrastructure.

  • Security.

PepMed is not responsible for third-party services to the extent that the applicable third party independently controls its products, systems, availability, or conduct.

Third-party services may be subject to their own terms and privacy policies.

20. Privacy

PepMed's collection, use, and disclosure of Personal Information are described in its Privacy Policy.

PHI subject to healthcare privacy laws may also be governed by PepMed's Notice of Privacy Practices.

By using PepMed Services, you acknowledge that you have had an opportunity to review the applicable privacy notices.

21. Acceptable Use

You agree not to:

  • Gain unauthorized access to PepMed systems.

  • Share account credentials with unauthorized persons.

  • Interfere with security or functionality.

  • Introduce malware or harmful technologies.

  • Scrape or extract information without authorization.

  • Circumvent security controls.

  • Impersonate another person.

  • Submit fraudulent information.

  • Misuse prescription functionality.

  • Attempt to obtain medications through fraud or misrepresentation.

  • Harass healthcare providers, employees, contractors, or other users.

  • Use PepMed for unlawful purposes.

PepMed may restrict or terminate access where reasonably necessary to protect patients, providers, systems, or comply with law.

22. Intellectual Property

PepMed's name, trademarks, branding, Website design, graphics, software, educational content, articles, photographs, videos, and other original materials are owned by or licensed to PepMed and protected by applicable intellectual-property law.

You may use PepMed content for personal, non-commercial purposes unless otherwise stated.

No ownership rights are transferred through your use of PepMed.

23. User Submissions

You represent that you have the right to provide information submitted to PepMed.

You may not knowingly submit information that:

  • Violates another person's rights.

  • Is fraudulent.

  • Is unlawful.

  • Contains malicious software.

  • Is intentionally false or misleading in a manner relevant to healthcare services.

You are responsible for providing accurate information relevant to your healthcare.

Failure to provide complete or accurate medical information may affect a healthcare provider's ability to safely evaluate or treat you.

24. Website and Service Availability

PepMed does not guarantee uninterrupted availability of its Website, portal, communications, integrations, or other technology.

Services may be unavailable because of:

  • Maintenance.

  • Technical problems.

  • Third-party outages.

  • Internet disruptions.

  • Security events.

  • Changes to integrations.

  • Circumstances outside PepMed's reasonable control.

PepMed may modify, suspend, or discontinue features where reasonably necessary.

25. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPMED'S NON-CLINICAL DIGITAL SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

PEPMED DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, OR ACCURACY.

NOTHING IN THESE TERMS IS INTENDED TO DISCLAIM OR LIMIT PROFESSIONAL DUTIES OR PATIENT RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.

26. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPMED AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF NON-CLINICAL WEBSITE OR DIGITAL SERVICES.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited, including applicable professional healthcare obligations.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless PepMed and its owners, officers, employees, contractors, affiliates, and representatives from claims arising from:

  • Your unlawful use of the Services.

  • Your material violation of these Terms.

  • Your intentional misuse of PepMed systems.

  • Your violation of another person's rights.

This provision does not apply where prohibited by applicable law.

28. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies.

Healthcare services remain subject to the laws applicable to the patient, healthcare provider, and services involved.

29. Changes to These Terms

PepMed may update these Terms to reflect changes in:

  • Healthcare services.

  • Technology.

  • Communications.

  • Wearable integrations.

  • Pharmacy relationships.

  • Delivery services.

  • Legal requirements.

  • Business operations.

PepMed will update the Last Updated date and document version when revisions are made.

Where required by law, PepMed may provide additional notice or obtain consent before material changes become effective.

30. Severability

If any provision is determined to be invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law.

31. Entire Agreement

These Terms, together with PepMed's Privacy Policy and other policies, agreements, notices, and consents expressly applicable to a particular Service, constitute the applicable agreement concerning use of PepMed's digital Services.

Healthcare services may be subject to separate clinical, financial, telehealth, privacy, medication, and informed-consent documents.

Contact PepMed or the dispensing pharmacy promptly if a medication arrives damaged, compromised, at an inappropriate temperature where temperature control is required, or otherwise appears unsuitable for use.

Do not use medication that you reasonably believe has been damaged or compromised without first obtaining appropriate guidance.

16. Medications and Treatment

Information presented through PepMed does not guarantee access to a particular medication or treatment.

Treatment depends on factors including:

  • Medical appropriateness.

  • Provider judgment.

  • Patient history.

  • Laboratory information.

  • Applicable law.

  • State availability.

  • Pharmacy availability.

  • Medication availability.

  • Regulatory requirements.

17. Compounded Medications

PepMed healthcare providers may, where clinically appropriate and legally permitted, prescribe compounded medications.

Compounded medications are not FDA-approved in the same manner as FDA-approved drug products. The FDA does not review compounded medications for safety, effectiveness, or quality before marketing in the same manner as FDA-approved drugs.

The decision to prescribe a compounded medication is made by an appropriately licensed healthcare provider based on clinical judgment, applicable law, patient circumstances, and product availability.

Additional medication-specific disclosures or consents may be provided where appropriate.

18. No Guarantee of Results

Healthcare and wellness outcomes vary between individuals.

PepMed does not guarantee:

  • Improved performance.

  • Improved recovery.

  • Improved sleep.

PHI subject to healthcare privacy laws may also be governed by PepMed's Notice of Privacy Practices.

By using PepMed Services, you acknowledge that you have had an opportunity to review the applicable privacy notices.

21. Acceptable Use

You agree not to:

  • Gain unauthorized access to PepMed systems.

  • Share account credentials with unauthorized persons.

  • Interfere with security or functionality.

  • Introduce malware or harmful technologies.

  • Scrape or extract information without authorization.

  • Circumvent security controls.

  • Impersonate another person.

  • Submit fraudulent information.

  • Misuse prescription functionality.

  • Attempt to obtain medications through fraud or misrepresentation.

  • Harass healthcare providers, employees, contractors, or other users.

  • Use PepMed for unlawful purposes.

PepMed may restrict or terminate access where reasonably necessary to protect patients, providers, systems, or comply with law.

22. Intellectual Property

PepMed's name, trademarks, branding, Website design, graphics, software, educational content, articles, photographs, videos, and other original materials are owned by or licensed to PepMed and protected by applicable intellectual-property law.

You may use PepMed content for personal, non-commercial purposes unless otherwise stated.

No ownership rights are transferred through your use of PepMed.

23. User Submissions

You represent that you have the right to provide information submitted to PepMed.

You may not knowingly submit information that:

  • Violates another person's rights.

  • Is fraudulent.

  • Is unlawful.

  • Contains malicious software.

  • Is intentionally false or misleading in a manner relevant to healthcare services.

You are responsible for providing accurate information relevant to your healthcare.

Failure to provide complete or accurate medical information may affect a healthcare provider's ability to safely evaluate or treat you.

24. Website and Service Availability

PepMed does not guarantee uninterrupted availability of its Website, portal, communications, integrations, or other technology.

Services may be unavailable because of:

  • Maintenance.

  • Technical problems.

  • Third-party outages.

  • Internet disruptions.

  • Security events.

  • Changes to integrations.

  • Circumstances outside PepMed's reasonable control.

PepMed may modify, suspend, or discontinue features where reasonably necessary.

25. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPMED'S NON-CLINICAL DIGITAL SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

PEPMED DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, OR ACCURACY.

NOTHING IN THESE TERMS IS INTENDED TO DISCLAIM OR LIMIT PROFESSIONAL DUTIES OR PATIENT RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.

26. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPMED AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF NON-CLINICAL WEBSITE OR DIGITAL SERVICES.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited, including applicable professional healthcare obligations.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless PepMed and its owners, officers, employees, contractors, affiliates, and representatives from claims arising from:

  • Your unlawful use of the Services.

  • Your material violation of these Terms.

  • Your intentional misuse of PepMed systems.

  • Your violation of another person's rights.

This provision does not apply where prohibited by applicable law.

28. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies.

Healthcare services remain subject to the laws applicable to the patient, healthcare provider, and services involved.

29. Changes to These Terms

PepMed may update these Terms to reflect changes in:

  • Healthcare services.

  • Technology.

  • Communications.

  • Wearable integrations.

  • Pharmacy relationships.

  • Delivery services.

  • Legal requirements.

  • Business operations.

PepMed will update the Last Updated date and document version when revisions are made.

Where required by law, PepMed may provide additional notice or obtain consent before material changes become effective.

30. Severability

If any provision is determined to be invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law.

31. Entire Agreement

These Terms, together with PepMed's Privacy Policy and other policies, agreements, notices, and consents expressly applicable to a particular Service, constitute the applicable agreement concerning use of PepMed's digital Services.

Healthcare services may be subject to separate clinical, financial, telehealth, privacy, medication, and informed-consent documents.
